Bluecharge Direct Ltds Terms and Conditions (updated 12/12/2017)

Definitions

The "Buyer" means the customer who accepts a quote from the Seller or whose order for the Goods is accepted by the Seller.

The "Seller" means Bluecharge Direct Ltd.

“Goods” means the items that the seller is to supply.

“Suppliers” means any third party needed by the seller to fulfil the contract including but not limited to manufacturers, distributors and couriers.

"Working Days" are Monday to Friday inclusive and excludes Saturday Sunday and all Bank holidays in England.

“In writing” shall include electronic mail (email), fax and other such means of communication.

Conditions

All orders are accepted by the seller in accordance with these conditions. These conditions override any previous versions or conditions applied to any negotiations in previous dealing between the seller and the buyer. It is the buyers responsibility to check the terms and conditions every time they visit the website.

No contract for the sale of goods shall arise until payment has been received and the seller has despatched the goods unless agreed beforehand and confirmed in writing by the seller.

Under such circumstances the seller may delay the performance of or cancel the whole or any part of the contract.

Prices

Prices for goods are in £ sterling and inclusive of VAT. The seller reserves the right to change their prices at any time and without notice. The price charged will be the price displayed on the website at the time the order is accepted. All offers are subject to availability.

We reserve the right to cancel any order and refund all monies paid in the event of a mistake in price or availability (to include mistakes made by the seller or any third party supplier).

Payment

Payment must be made in full before goods will be despatched unless agreed in advance and confirmed in writing by the seller.

The seller is VAT registered and a full VAT invoice will be provided upon request.

Delivery/Shipping

Our standard delivery methods are Royal Mail 24, Royal Mail 48 or Royal Mail Airmail for international orders. We also offer express delivery by courier for UK mainland orders which will usually be next day. All stated delivery times are estimates. The seller shall endeavour to meet those delivery estimates but cannot guarantee delivery times and as such cannot be held responsible for late deliveries or damage in transit as such the seller cannot be held liable for any losses or expenses incurred by the buyer as a result of late delivery or damage in transit. The goods may be delivered before the stated delivery date upon giving reasonable notice to the buyer. We aim to despatch orders placed before 3pm the same day, orders placed after this time will be despatched the following working day. However, dispatch times cannot be guaranteed.

If couriers are unable to make delivery due to the buyer not being available to receive the package then a card should be left. Instructions to collect or rearrange delivery may vary depending on courier. If the buyer fails to arrange collection/re-delivery the package will be returned to the seller. In this case the buyer shall be liable for the original carriage fee. If the buyer requests re-delivery they shall also be liable for second delivery charge.

Any damages must be reported in writing within 5 working days of despatch.

The delivery method used shall ultimately be at the sellers discretion. Where a specific delivery service has been selected the seller will make every effort to use that service if the insurance cover is adequate and the service is available, however the seller reserves the right to use an equivalent or upgraded service where the service selected is not deemed suitable by the seller.

“Next day” delivery services will only be delivered on working days and this cannot be guaranteed.

Force Majeure

The seller shall not be liable to the buyer in any manner or be deemed to be in breach of these Conditions because of any delay in performing or any failure to perform any of the Company's obligations under this contract if the delay or failure was due to any cause beyond the sellers reasonable control. This shall include but not be limited to:

  • Acts of god, flood, fire, storm, accident or explosion.
  • War.
  • Import or export regulations or embargoes.
  • Government actions.
  • Difficulty or delay in obtaining supplies of Goods or labour including industrial action and disputes involving employees of the seller or suppliers.
  • Import or export regulations or trade embargoes.
  • Inclement weather.

Ownership

Ownership of the goods shall pass from the seller to the buyer on delivery of the goods. Should it be agreed that payment be made at a time after delivery then the goods shall remain the property of the seller until such time full payment has been received in cash or cleared funds.

Until ownership passes to the buyer, the buyer must hold the Goods on a fiduciary basis as the sellers bailee. If payment is not received in full by the due date the seller shall be entitled, without notice, to enter upon any premises occupied or owned by the buyer to recover the goods.

Warranties

The seller will where possible transfer to the customer the benefit of any manufacturer warranty or guarantee. Not all goods are supplied with a manufacturer’s warranty.

The seller warrants that the goods will match the description given by the seller at the time of delivery.

The seller shall be under no liability in respect to any defect arising from:

  • Fair wear and tear.
  • If the defect arises because the buyer has altered or repaired the goods without the written consent of the seller.
  • The buyer not following the manufacturers' instructions for usage, installation, storage, use or maintenance of the goods.
  • Failure to follow the sellers instructions (written or oral).
  • Wilful damage.
  • Negligence.

The seller is not responsible for any incompatibility issues and is under no circumstances liable to the buyer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the contract for:

  • Any loss of profits, sales, business, or revenue.
  • Loss of business opportunity.
  • Loss of business opportunity.
  • Loss of goodwill.
  • Loss of business opportunity.
  • Any indirect or consequential loss.
  • Loss of contract.
  • Loss and/or corruption of data and/or other information.
  • Downtime.
  • Any costs associated with procuring substitute.xi) The liability of the seller shall not exceed the cost of goods in any circumstances.

Returns and Refunds

Buyers will be fully reimbursed of all costs relating to the sale including return postage in the following circumstances:

  • The buyer reasonably believes that the goods received do not match the description given on the items product page.
  • If goods received are faulty in a way not described on the items product page.

Orders cancelled under the terms of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations (CCR):

The buyer has the right to cancel any order placed under the cooling off period. The cooling off period is 14 calendar days from the day after receiving the goods ordered. Once goods have been used the Consumer Cancellation Regulations cooling off period no longer applies. Cancellation should be given in writing by the buyer within the cooling off period.

Business to business sales are not covered by the Consumer Contracts Regulations.

Where the buyer fully cancels their order and had selected a standard delivery service then the standard delivery charge shall be refunded. Orders partially cancelled do not qualify a delivery charge refund. Express delivery charges will only be refunded if the order is cancelled prior us to booking the express delivery service.

All refunds due will be processed within 14 days of receiving returned goods.

WEEE & ROHS

As a responsible seller all products sold by Bluecharge Direct Ltd are sourced from UK based WEEE registered suppliers. In addition all products conform to ROHS. As an EEE reseller we will take your old EEE product on a like for like basis for recycling. This service is free of charge. If you would like to recycle our old EEE product through us please contact us for instructions of where to send/deliver the product.

Trademarks and Intellectual Property

The buyer shall acknowledge the intellectual property rights of the seller, suppliers and manufacturers of the goods featured on this website.
